1. Agreement to Terms

By accessing or using RMVFinder at rmvfinder.com or app.rmvfinder.com (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.

These Terms constitute a legally binding agreement between you and RMVFinder (“we,” “us,” or “our”).

2. What RMVFinder Is

RMVFinder is an independent, third-party appointment monitoring tool that checks the Massachusetts Registry of Motor Vehicles (RMV) scheduling system for available appointments based on your preferences. We notify you when a matching appointment is found.

RMVFinder is not affiliated with, endorsed by, or operated by Mass.gov, the Massachusetts RMV, the Massachusetts Department of Transportation (MassDOT), or any government entity.

We do not guarantee that appointments will be found or that the RMV's scheduling system will remain accessible or functional.

3. Eligibility

You must be at least 16 years old to use the Service, consistent with the minimum age to obtain a Massachusetts learner's permit.

If you are between the ages of 16 and 17, you represent that you have obtained permission from a parent or legal guardian to use the Service, and that your parent or guardian has reviewed and agreed to these Terms on your behalf.

If you are under 16, you may not use the Service.

4. How the Service Works

4.1 RMV Scheduling URL

To use the Service, you must provide a valid RMV Scheduling URL. This URL is generated by you through the Massachusetts RMV website and contains a session token that allows our system to check appointment availability on your behalf.

By providing your RMV Scheduling URL, you:

Confirm that the URL belongs to your own RMV account
Authorize RMVFinder to use the URL solely to check appointment availability
Acknowledge that you are responsible for keeping this URL confidential
Agree not to provide URLs belonging to other individuals

4.2 Monitoring

Our system periodically checks the Massachusetts RMV scheduling system for appointments matching your selected locations, date range, and time preferences. We do not guarantee check frequency, uptime, or that we will detect every available appointment before it is taken.

4.3 Notifications

When a matching appointment is found, we will attempt to notify you via your chosen method (browser notification, email, or SMS). Notification delivery is not guaranteed and may be delayed due to factors outside our control, including but not limited to internet connectivity, browser settings, carrier delays, or spam filtering.

4.4 Auto-Booking

Auto-booking is an optional feature that, when enabled, instructs RMVFinder to attempt to schedule an RMV appointment on your behalf when a matching slot is detected.

By enabling auto-booking, you:

Explicitly authorize RMVFinder to interact with the Massachusetts RMV scheduling system using your RMV Scheduling URL to complete an appointment booking in your name
Confirm that the RMV account and Scheduling URL you have provided belong to you
Acknowledge that you are responsible for attending, canceling, or rescheduling any appointment booked on your behalf
Accept that you have reviewed and are eligible for the appointment type you are monitoring

What we do not guarantee:

Auto-booking operates in real time against a live, high-demand scheduling system. We do not guarantee that:

A booking attempt will succeed before the appointment is claimed by another user
The appointment booked will exactly match your preferred location, date, or time beyond the parameters you configured
The booking will be confirmed by the Massachusetts RMV without additional action required from you

You remain responsible:

RMVFinder acts solely as an automated agent executing an action you have pre-authorized. You are solely responsible for:

Verifying the details of any appointment booked on your behalf before attending
Canceling or rescheduling an appointment if it no longer suits your needs, directly through the Massachusetts RMV website
Any no-show fees, penalties, or consequences imposed by the Massachusetts RMV for missed or uncanceled appointments
Ensuring you meet all requirements for the appointment type at the time of your scheduled visit

Disabling auto-booking:

You may disable auto-booking at any time through the application. Disabling it will not cancel any appointment that has already been booked. To cancel a booked appointment, you must do so directly through the Massachusetts RMV website.

No liability for booking errors:

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RMVFINDER SHALL NOT BE LIABLE FOR ANY CLAIM ARISING FROM AN AUTO-BOOKED APPOINTMENT, INCLUDING BUT NOT LIMITED TO: INCORRECT APPOINTMENT TYPE, WRONG LOCATION, SCHEDULING CONFLICTS, FAILURE TO BOOK, OR ANY CONSEQUENCE OF ATTENDING OR MISSING A BOOKED APPOINTMENT.

5. Your Responsibilities

You agree to:

Use the Service only for your own personal appointment monitoring
Provide accurate information including your own RMV URL and valid contact details
Comply with all applicable Massachusetts laws and the Massachusetts RMV's terms of use
Not use the Service to monitor appointments on behalf of others for commercial gain
Not attempt to reverse-engineer, scrape, or abuse the Service
Not use automated tools to interact with RMVFinder beyond its intended functionality
Not use the Service in any manner that could disrupt or overload our systems or the Massachusetts RMV's systems

6. Third-Party Systems

RMVFinder interacts with the Massachusetts RMV's scheduling website to provide its core functionality. We have no control over that website and are not responsible for:

Changes to the RMV's website that may break or degrade our Service
Appointment availability or accuracy of the RMV's scheduling data
Any actions taken by the Massachusetts RMV regarding your account or appointment
Downtime or maintenance of the RMV's systems

The RMV may change its website structure, authentication system, or scheduling process at any time. Such changes may temporarily or permanently affect our ability to deliver the Service. We will make reasonable efforts to restore functionality but cannot guarantee it.

7. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

We specifically disclaim any warranty that:

The Service will be uninterrupted, timely, or error-free
Appointment availability information will be accurate or complete
Notifications will be delivered in time to act on an appointment
The Service will remain compatible with the Massachusetts RMV's systems

Your use of the Service is at your own risk.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RMVFINDER AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

This includes but is not limited to:

Missed appointments
Failure to receive notifications
RMV-related penalties, fees, or legal consequences from driving with an expired license
Any action taken or not taken based on information provided by the Service

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED FIFTY DOLLARS ($50.00).

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such cases, our liability is limited to the maximum extent permitted by law.

9. Indemnification

You agree to indemnify, defend, and hold harmless RMVFinder and its operators from any claims, losses, damages, liabilities, and expenses (including reasonable attorney's fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third party's rights, including the Massachusetts RMV's terms of use; or (d) any information you provide to the Service.

10. Intellectual Property

All content on rmvfinder.com and app.rmvfinder.com, including but not limited to text, graphics, logos, and code, is the property of RMVFinder and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

11. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason, including if we believe you have violated these Terms.

You may stop using the Service at any time by discontinuing access.

12. Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Massachusetts.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last Updated” date. Continued use of the Service after changes are posted constitutes your acceptance of the updated Terms. If changes are material, we will make reasonable efforts to notify you.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and RMVFinder regarding your use of the Service and supersede any prior agreements.
